PUBLIC OFFER AGREEMENT
Lupashko Pavlo Pavlovich Individual Entrepreneur, acting based on Extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Associations 379202210163 (hereinafter referred to as the Contractor), pursuant to Article 633 of the Civil Code of Ukraine, offers an unlimited number of individuals (hereinafter referred to as the User(s) and/or Passenger(s)) to enter into a Public Offer Agreement (hereinafter referred to as the Agreement) in order to search for and/or purchase tickets on the website likebus.ua (hereinafter referred to as the Website) on the following terms and conditions.
TERMS AND DEFINITIONS
Agent – shall mean an individual who acts as an intermediary in distributing Carrier's tickets through the Website.
Baggage - shall mean the cargo that the bus is authorized to carry, and its dimensions and weight are defined in this Agreement.
Ticket (electronic ticket) shall mean a visual representation of an electronic travel document generated by the Website in a specified format, containing necessary information about the transportation service. It serves as an agreement between the Carrier and the Passenger, granting the Passenger the right to receive transportation services exclusively along the route specified in the ticket. The ticket is sent to the e-mail address provided during booking or issued to the User in another appropriate manner. Ticket No. serves as public offer agreement No. and passenger transportation agreement No. The ticket is a personal document for bus travel and cannot be transferred to another person. The ticket also serves as a confirmation of the insurance agreement. The ticket is valid from the moment it is paid and remains valid until the date and time of the actual arrival at the destination point specified therein.
Commission fee – shall mean the payment made to the Contractor and/or Agent for the services provided in purchasing the Ticket. The commission fee is included in the ticket price and is paid by the User. The commission fee amount depends on the payment method and ticket type, as well as the terms outlined in the agreement between the Carrier and the Contractor and/or Agent. These terms can vary. If a Subagent sells the ticket, in such a case, the Subagent's commission fee is already included in the Agent's commission fee and cannot surpass it.
Website User – shall mean any capable person, individual entrepreneur and/or their representative, or representative of a legal entity who has agreed to the terms of the offer and uses the website in any way.
Passenger shall mean an individual who has a ticket in his/her name and intends to use or has used the transportation services provided by the Carrier.
Carrier - shall mean a legal entity and/or an individual entrepreneur, who is part of the LIKEBUS carrier group, providing direct passenger and baggage transportation services by motor transport, selected and paid for through the booking and payment system on the Website, and collaborates with other legal entities and individual entrepreneurs under partnership, agency, and other agreements.
Payer – shall mean an individual, legal entity, or individual entrepreneur who makes payment for services on behalf of the User/Passenger.
Service – shall mean a set of paid services that can be obtained by the Passenger under the terms, conditions, and procedures specified in this Agreement.
Transportation rules - shall mean the rules governing the transportation of passengers by the Carrier's buses, available on the Website, specifying the procedures for passenger and baggage transportation. These rules are binding and shall be adhered to by both the Carrier and the Passengers.
Website – located at https://likebus.ua, shall mean the publicly accessible Website for visual browsing at no cost to individuals. It provides functional features, pages, graphics, and other resources for acquiring services relating to the search for transportation options, routes, available seats, registration, and reservation, as well as the purchase of travel documents, such as tickets, and other related services.
The Parties – to the Public Offer Agreement shall be the Contractor and the User.
1. SUBJECT MATTER OF THE AGREEMENT
1.1 The subject matter of this Offer is the provision of services for reserving, issuing, and selling tickets for travel routes by the Contractor to Users under the conditions determined by this Agreement, as well as the Users can access other services on the website likebus.ua, such as storage space for luggage and pets, according to the date, time, and direction chosen by the User.
1.2 The User may act within the framework of the Agreement on his own behalf and for his own benefit and/or on behalf of a third party and for its benefit. In this case, the User acts exclusively within the powers granted to him by the third party.
1.3 The sale of Tickets to the User, including Electronic Tickets, is carried out exclusively on the terms of this Offer and only in the case of the complete and unconditional acceptance of the terms of this Offer by the User (acceptance of the Offer).
2. RIGHTS AND OBLIGATIONS OF THE PARTIES
2.1 The User shall have the right to:
2.1.1 Receive services under the Agreement;
2.1.2 Use the Ticket according to the chosen date, time, departure location, and selected Carrier;
2.1.3 Return the Ticket under the conditions determined by the Contractor;
2.1.4 In case of causing moral damage to the User due to the actions or omissions of the Contractor, the compensation amount, upon its proof and justification, cannot exceed an amount greater than the Ticket price.
2.1.5 Receive compensation if the journey is canceled by the Carrier.
- Travel on the next available route by the Carrier or its partner to the destination;
- Receive a refund for the ticket price corresponding to the unused portion of the service (for the journey not taken).
2.2 The User shall be obliged to:
2.2.1 Make the payment for the Ticket in the amount of 100% of the specified price on the Website before the start of transportation;
2.2.2 Inform the Contractor about the impossibility to use the Ticket due to any reason;
2.2.3 Familiarize oneself with the terms hereof. If the User purchases a ticket for a third party, he shall make sure to acquaint the third party (Passenger) with the terms hereof.
2.3 The Contractor shall have the right to:
2.3.1 Act on behalf of the Carrier within the boundaries of authority as defined by contractual relations.
2.3.2 Record telephone conversations with the User and/or Passenger in all instances related to the purchase, use, and refund of the Ticket acquired via the Website.
2.4 The Contractor shall be obliged to:
2.4.1. Send the Ticket to the User in accordance with the form established and accepted by the Carrier;
2.4.2. Inform the User about changes in the conditions of the provision of services;
2.4.3. Notify the User of changes or cancellation of the journey.
2.4.4. Receive inquiries from the User, consider them independently or forward them for consideration to the respective Carrier and inform the User about the inquiry's (complaint's) consideration. In case the inquiry (complaint) is sent to the Carrier for consideration, the Contractor shall inform about the results of its consideration by the Carrier.
2.4.5. Responses to inquiries will be provided in a manner consistent with their receipt. Response forwarding to third parties, including at the request of the User, will not be made.
3. ORDERING AND TICKET REFUND POLICY
3.1 To book and purchase a Ticket via the Website, it is necessary to provide specific information, in particular: Passenger's first and last name, date of birth, valid email address, and phone number. The User shall verify this information on the Website before confirming the booking. The User bears the risks of providing incorrect information on the Website. Upon receiving the ticket, the user should promptly verify its accuracy and ensure that the ticket price corresponds to the amount paid. Any claims made after that time will not be satisfied.
3.2 The User shall review the Offer Agreement’s terms before making payment. The User shall have the right to pay for their tickets using any of the methods the Contractor offers. Information regarding these methods is available on the Website. Payment for the ticket shall be made after selecting a seat on the Website. If this reservation period elapses, the seat reservation and order are canceled.
3.3 When buying a Ticket, it is necessary to provide payment details linked to bank cards, including the card number and expiration dates. This data needs to be entered for every payment through the secure service of the selected payment system.
3.4 If the User is not the Passenger, by making a reservation and payment for the services, he confirms that he is authorized by the Passenger on whose behalf the reservation and payment for the services are made and undertake to inform the Passenger about the terms of this Agreement and other information necessary for obtaining the passenger transportation service.
3.5 After the User processes and pays for the ticket on the website, the electronic booking and sales system generates the ticket and sends it to the User's e-mail.
3.6 The User who has made payment or reserved a ticket and other carrier services via the website confirms their knowledge of and unconditional acceptance of the terms in this Offer Agreement, and commits to fulfilling them. The terms of this Contract are applicable to individuals on whose behalf the tickets were purchased, and the consent to and obligation of said terms apply.
3.7 The Carrier determines fares for travel, which are dynamic and subject to change based on various factors such as seat availability, purchase time and day, seasonality, and others. The decision to change fares, introduce or cancel special fares, as well as the amount and conditions of their application, are made solely by the Carrier. The Passenger accepts these conditions and agrees that tickets for the same route at different times may vary in price.
3.8 The funds received from the User for the purchase of the Ticket, including the commission fee (if included in the Ticket price), belong to the Contractor.
3.9 The User is solely responsible for all commission expenses and other specified bank charges that the issuer of their credit or debit card may add to the Ticket price or additional services.
3.10 Banking services related to the transfer of funds under the Agreement shall be paid for by the Party rendering these services.
3.11 The User's identifier shall be the e-mail address and/or phone number provided during the purchase of the Ticket.
3.12 Contacting by the phone number or e-mail address provided during the Ticket purchase allows the Contractor to identify the User as the rightful Party to the Agreement with corresponding rights and obligations. This facilitates actions related to both the Agreement and the Ticket purchased.
3.13 If the User contacts the Contractor by a phone number and/or e-mail address other than the one provided when purchasing the Ticket, the Contractor shall be entitled to require the User to additionally identify himself/herself as the rightful Party to the Agreement.
3.14 If the User cannot be identified as a party to the Agreement, the Contractor reserves the right to decline the inquiry.
3.15 The responsibility of keeping and accessing the phone number and email address lies with the User. The Passenger shall be in touch with the specified phone number 12 hours before the departure of the bus and throughout the journey. If the Contractor and/or Carrier are unable to contact the User or Passenger by the phone numbers provided on the Website, the negative consequences of this situation are the User's responsibility.
3.16 Ticket refund policy.
3.16.1 If the Carrier notifies of journey cancellation for any reason, the Contractor shall reimburse the Funds received as payment for the Ticket using the same method they were received, in the amount of 100% of the Ticket price. Alternatively, if possible, the Contractor may offer another Ticket for the journey by the same or another Carrier.
3.16.2 If the Ticket is returned on the User's own initiative, the Agent shall refund the funds to the User according to the following formula: RA = TP - (TP x % CF) - (TP x % CR), where
RA- refund amount paid to the user after deduction of the commission fee and deduction by the carrier;
TP - ticket price paid by the User for the purchased Ticket;
% CF - % commission fee received by the Agent for the ticketing services provided;
% CR - the percentage of the Carrier's retentions, which are made according to the following rules:
- returning more than 72 hours before departure - 10% of the ticket price is retained (CR);
- returning more than 24 hours but less than 72 hours before departure - 30% of the ticket price is retained (CR);
- returning less than 24 hours but more than 12 hours before departure - 50% of the ticket price is retained (CR);
- returning less than 12 hours before departure - 100% of the ticket price is retained.
3.16.3 Refunds for tickets, after all mandatory retentions, are processed either in the User's personal account or by submitting a request to the e-mail
[email protected]. The refund will be issued within 14 business days from the receipt of the application.
3.16.4 For tickets that have been rescheduled for another date at the request of the User, funds will not be refunded in any form. Ticket rescheduling for another date is possible only once.
3.16.5 In case of purchasing tickets through Agents, all claims for returns of tickets and/or funds shall be resolved with such Agent.
3.16.6 In case of returning the ticket and its cost to the User, it is considered that the User and the Passenger no longer have any claims against the Contractor and the Carrier.
4. CONDITIONS FOR THE PROVISION OF PASSENGER AND BAGGAGE TRANSPORTATION SERVICES BY THE CARRIER
4.1 General terms and conditions of transportation services:
4.1.1 Passenger and baggage transportation services are provided by the Carrier solely on the basis of a ticket.
4.1.2 The ticket is a Transportation Agreement concluded between the Passenger and the Carrier, based on which the Passenger shall have the right to use the vehicle and related services exclusively along the route specified in the ticket.
4.1.3 The ticket is a personal document for traveling by bus and cannot be transferred to another person.
4.1.4 The ticket is valid from the moment of its payment and is valid until the date and time of arrival at the destination point specified therein.
4.1.5 The Passenger, upon receiving the ticket in his/her name, confirms that he/she is aware of the terms of this Agreement and unconditionally accepts them.
4.1.6 The Passenger is obliged to comply with the Rules of Transportation, which are posted on the Website, customs, and international laws.
4.1.7 When purchasing a Ticket using the Website for a direct journey or transfer, the User shall independently determine a sufficient amount of time for arrival and making the transfer. The recommended waiting time at the transfer point is 4 hours for domestic journeys and 12 hours for international journeys from the scheduled arrival time. The indication in the ticket of the bus arrival time at the stop according to the transport route is approximate and not an essential condition of the Transportation Agreement, the non-compliance of which entails legal consequences for the Carrier.
4.1.8 The Passenger is obliged to present the ticket for inspection to the Carrier's employee together with an identity document when boarding the bus. When boarding an international bus, the Passenger shall present to the Carrier's employee documents that entitle them to cross an international border.
4.1.9 The Passenger is required to present a document indicating eligibility for a discount or privilege on services. In the absence of a document confirming the justification for the discount or privilege, the Passenger shall have the right to use the service only after paying an additional fee to the standard (without discount) price of the service.
4.1.10 The passenger shall keep the ticket until arrival at the destination specified in the ticket.
4.1.11 If a ticket is lost prior to departure, it can be replaced at the point of sale
4.1.12 The ticket shall be a confirmation of the insurance contract.
4.1.13 The Passenger shall arrive for boarding at least 30 minutes before the departure of the bus. After checking in their baggage at the baggage compartment, the Passenger shall present all necessary documents and hand baggage to the Carrier's representative (driver, controller, etc.), who will designate the Passenger's seat in the bus. If the seating arrangement is specified in the ticket, the Passenger shall take the designated seat.
4.1.14 The Carrier reserves the right to require the Passenger to move to another seat than the one specified in the ticket. Once the Passenger has taken his/her seat, he/she shall not impede the boarding of other Passengers.
4.1.15 The Carrier shall have the right to change the bus during the journey, change the Passenger's seat in the bus without their prior consent and notification, or when replacing the bus to ensure the highest quality of the journey. The bus layout provided at the time of ticket purchase is for informational purposes and may be subject to changes in seating arrangement and aisles.
4.1.16 In case of the Passenger's absence and failure to board the bus at the specified time and departure location stated in the ticket, the Transportation Service Agreement is considered terminated at the Passenger's initiative. The Carrier reserves the right to sell the ticket for the vacant seat.
4.1.17 For safety reasons, ticketless persons who accompany the travelers and other individuals, except passengers, are not allowed into the bus cabin.
4.1.18 Children under the age of 12 are prohibited from sitting in seats near the drivers.
4.1.19 The Carrier shall have the right to temporarily or completely suspend the provision of passenger and baggage transportation services in case of force majeure events (severe weather conditions, natural disasters, epidemics, other emergencies, actions of state authorities, enactment of new laws, military aggression, road accidents, etc.), bus breakdown, or any other circumstances threatening the lives and health of passengers or other individuals, without compensating the cost of the paid passenger and baggage transportation services.
4.1.20 The Carrier shall have the right to stop the movement of the vehicle (bus) in case of a threat to the life and health of Passengers or other individuals and to continue the movement after such circumstances have ended;
4.1.21 In case of bus breakdown during transportation, the Passenger shall have the right to:
- Receive a 100% compensation of the Ticket price, which will be considered termination of the Transportation Agreement and absence of claims against the Carrier and the Contractor;
- Transfer to another bus provided by the Carrier. Proper execution of the Transportation Agreement will be considered transportation of the Passenger to the destination specified in his/her ticket. In this case, it will be considered that the Passenger received the services in full and has no claims against the Contractor or the Carrier.
4.1.22 The Carrier shall have the right not to allow the Passenger to board the bus if he/she comes in a drunken state (with signs of alcohol and/or drug intoxication), with obvious symptoms of a disease that is dangerous to other passengers on the bus, and/or in dirty clothes, and/or violates the rules of conduct in public places, as well as if his/her actions disturb the peace or create a danger to other passengers. In this case, the fare is not refunded, and the Carrier/crew is not responsible for such actions.
4.1.23 The Carrier may refuse to transport the Passenger during boarding, while the journey is in progress, and disembark him/her at any point along the route if the Passenger violates the terms of this Agreement regarding the order of transportation, disturbs the crew's work with his/her actions, disturbs the peace of other passengers, or poses a danger to others. In such a case, the fare is not refunded, and the Carrier/crew is not responsible for such actions.
4.1.24 The Carrier shall have the right to engage third parties to provide the services stipulated in the Transportation Agreement;
4.1.25 The bus makes stops along the route, the number and duration of which are announced by the bus crew. If a Passenger does not adhere to the announced stop time, the driver shall have the right to continue the journey along the route, and the Passenger continues the journey to the destination independently without compensation for the remaining distance. In this case, the Carrier is not responsible for the baggage left on the bus. Such baggage is stored by the Carrier for two days and then transferred to the lost and found office.
4.1.26 The bus schedule does not include time for the Passenger to process Tax Free.
4.1.27 In case additional services (such as warm beverages, light snacks, newspapers, magazines, movie screenings, Wi-Fi, internet connectivity, power outlets, pillows, blankets, toilet, air conditioning, etc.) that are optionally provided by the Carrier are not available, the Passenger is not entitled to a refund for the cost of these services.
4.1.28 The Carrier shall have the right to install video surveillance systems inside the vehicle (bus) to ensure 24/7 passenger safety, in accordance with the United Nations Convention against Transnational Organized Crime, the Council of Europe Convention on Actions against International Terrorism and Human Trafficking.
4.1.29 Complaints submitted in writing to the legal address of the Carrier are processed within 30 days from the date of receipt. If the Passenger's complaints are related to services provided by partners, agents, or any other individuals on behalf of and in the interests of the Carrier, the processing time for such complaints may be extended to 60 working days.
4.1.30 The Carrier shall not be liable to the Passenger for legal relations that occurred before or during bus transportation between the Passenger and the Carrier's crew, including those services that were paid to the latter but are not provided for by this Agreement or the Rules of Transportation. The Passenger shall resolve all disputes on such matters independently and shall have no right to make claims against the Carrier.
4.2 International route transportation policy.
4.2.1 On international routes, general terms and conditions of transportation services apply, as well as additional conditions specified in clause 4.2. hereof.
4.2.2 Before using the passenger and baggage transportation service on an international route provided by the Carrier, the Passenger is obligated to familiarize oneself independently with the current border crossing rules and the list of required documents.
4.2.3 The Passenger during international transportation by road, 12 hours before crossing the border, at the time of crossing the border, and 12 hours after, is required to have valid and properly issued documents necessary for entry into the destination countries, countries along the route, and present them to the Carrier upon request. These documents may include:
- European Union passport for entry and/or transit, stay in the territory of the EU countries, Schengen countries or other foreign countries, if the country's domestic legislation does not require the citizen to have other travel documents;
- Biometric passport; passport and visa in this passport for entry and/or transit, stay in the territory of the country subject to visa regime established by the country's legislation;
- Child's passport, child's travel document, and visa in this passport/document for entry and/or transit, stay in the territory of the country subject to visa regime established by the country's legislation
- For traveling with children, additional travel documents might be required, such as birth certificates, notarized authorization from parents, divorce certificate, court order, etc. The list of documents depends on the legislation of the country the child is traveling to/through/from;
- Diplomatic passport, official passport, and visa, if required by the legislation of the transit country or countries;
- Veterinary and other documents required for crossing the borders of Ukraine and transit countries with animals;
- Other documents required by foreign states for crossing the borders of Ukraine and transit countries.
4.2.4 During international passenger transportation by road, the Carrier shall have the right, prior to such transportation, to check the presence, but not the authenticity, of passengers' documents necessary for entry into the destination countries, transit countries, and refuse transportation to passengers who, upon their request, have not presented the required documents.
4.2.5 If the Passenger violates visa regulations, such as the expiration of the visa or replacement of the passport with another document, the Carrier reserves the right to refuse transportation. No monetary compensation will be provided to the Passenger for the unused ticket.
4.2.6 The Carrier shall not be obligated to compensate a Passenger for losses incurred due to the Carrier's refusal, in international travel, to transport a Passenger who fails to present the required entry documents for the destination country or countries along the route.
4.2.7 If, during border crossing, it is determined that the Passenger lacks or has improperly processed documents necessary for border crossing, resulting in any losses to the Carrier, the Passenger shall compensate the Carrier for all incurred losses, including fines, penalties, and legal expenses.
4.2.8 The Carrier shall not be held responsible for any losses, penalties, or consequences incurred by the passenger due to delays during travel or late arrival at their destination caused by circumstances beyond the carrier's control. Such circumstances include, but are not limited to, delays at customs borders, adverse weather conditions, traffic congestion, actions by government authorities, road repairs, actions of the Passengers themselves influencing the occurrence of such circumstances, and any other reasons that the Carrier could not prevent despite taking all necessary precautions
4.2.9 The Passenger is fully responsible for violating the legislation of the countries along the route. If the Passenger is detained during individual inspection, checking, or customs formalities due to personal violations, the transportation agreement is terminated, and the bus has the right to continue the journey without the Passenger. In this instance, the fulfillment of the transportation agreement is deemed accomplished, even though the transportation was executed with different specifications than initially planned. The fare is non-refundable, and the Passenger's demands relating to this matter cannot be met.
4.3 Bus code of conduct.
4.3.1 The Passenger is obliged to handle the bus equipment with care and prevent its damage. If the passenger causes damage to the vehicle (bus) or its equipment, the Passenger bears financial responsibility for the incurred damage and is obligated to compensate the Carrier for the related financial loss.
4.3.2 If the bus is equipped with seat belts, Passengers must fasten and use them as intended. Failure to comply may result in a direct monetary fine imposed on the Passenger or an obligation to compensate the Carrier if the fine was applied due to the Passenger's behavior. The Carrier is not liable for injuries sustained by Passengers who do not comply with this provision.
4.3.3 Boiling water may only be used with the driver's or bus attendant's permission during a stop to prevent accidents.
4.3.4 When using the restroom, Passengers shall follow sanitary rules and refrain from disposing of hygiene products or other items in the toilet. Passengers are also obligated to avoid any actions that may contribute to premature filling of the toilet.
4.3.5 During the journey, passengers may be offered the opportunity to watch movies and listen to music. As the Passengers have diverse preferences and opinions, the Carrier reserves the right to choose movies and music, but may take into account the opinions of the passengers.
4.3.6 During stops, the Passengers shall ensure that their seat back is upright, the tray table is closed, and the footrest is stowed away before leaving their seat.
4.3.7 During the journey, the Passengers are prohibited from:
- Transportation of weapons and other items excluded from civilian circulation, dangerous cargoes, including inflammable, explosive, and those that can dirty the vehicle or Passengers' clothing;
- Smoking, consumption of alcoholic beverages and drugs in the cabin, toilet, and service areas of the bus;
- Putting feet on the seats, blocking the aisles in the bus;
- Creating inconvenience for other Passengers or interfering with the crew's work, distracting the driver from operating the vehicle while in motion;
- Making alterations to the ticket and giving it to another person;
- Using emergency equipment without necessity;
- Walking around the cabin and standing in the aisles while the bus is moving without urgent necessity. Damages incurred as a result of moving around the cabin while the bus is moving will be considered the Passenger's fault.
- Putting feet on the seats, lying on the seats or on the bus floor.
- Littering in the cabin. Garbage shall be thrown into the trash cans at the stops.
- Distracting the driver while driving.
4.3.8 If a Passenger violates or fails to comply with the bus code of conduct, the Carrier reserves the right to remove said passenger from the bus without providing any monetary compensation for the ticket price.
4.4 Baggage transportation rules.
4.4.1 One Passenger is entitled to free transportation of:
- Baggage occupying 1 (one) baggage space and having dimensions not exceeding 60x40x40 cm, with a total weight of up to 25 kg.
- A carry-on bag weighing up to 5 kg, occupying 1 (one) space, is allowed. A carry-on bag is considered a bag that is easily portable and can be placed under the seat or in the overhead compartment above the Passenger's seat.
- Baby strollers when folded;
- Wheelchairs when folded.
4.4.2 If the baggage exceeds the size of 60x40x40 cm and weighs more than 25 kg, it can be accepted for transportation if there is available space in the baggage compartment and for an additional fee. The possibility of such transportation shall be agreed with the Carrier's office at least 24 hours in advance.
4.4.3 Additional baggage may only be transported if the baggage compartment has enough space, and should not exceed one baggage space. Additionally, a separate payment shall be made to the Carrier. Payment for the additional baggage to the Driver is prohibited. The additional baggage shall not exceed the size and weight of the main baggage. The driver determines the space available in the baggage compartment during boarding, considering the total number of passengers on the bus, distribution by cities, and other factors.
4.4.4 The Carrier shall not be liable for the Passenger's personal belongings and for keeping of baggage in the bus cabin, for the Passenger's loss of money, jewelry, passport, valuable papers, collectibles, items of scientific value, and other valuables not placed in the baggage compartment.
4.4.5 The Carrier is responsible only for the baggage that has been accepted for transportation, i.e., the Passenger was issued a baggage tag confirming the acceptance of the baggage.
4.4.6 The Carrier is not responsible for any damage caused to fragile items, perishable goods, improperly packed items, valuable items (money, documents, electronic and technical devices, etc.) transported in the baggage compartment.
4.4.7 The Carrier is not responsible for minor or surface damage to registered baggage transported in the baggage compartment, including broken wheels and handles, lost straps, and minor damages such as cuts, scratches, bends, or stains that occurred during normal wear and tear and usage during the journey.
4.4.8 Oversized items that have not been agreed upon with the Carrier's office 24 hours prior to transportation will not be accepted for transportation.
4.4.9 Bicycles may only be transported when disassembled and if there is space available in the baggage compartment, and such transportation has been agreed upon with the Carrier's office. If space is available, bicycles will be transported in the baggage compartment of the bus. The bicycle's front wheel must be removed and packed separately, and the bicycle itself shall also be properly packed. A disassembled and packed bicycle counts as two baggage units.
4.4.10 The Carrier is responsible for the lost baggage transported in the baggage compartment only if it is the Carrier's fault, as proven by the Passenger, but not exceeding the amount of 100 US dollars per person provided that a claim is submitted no later than three days from the departure date of the bus.
4.4.11 It is prohibited to transport baggage that poses a threat to the safety or health of other passengers, can damage other baggage, or the vehicle. The Carrier shall have the right to refuse to transport luggage if the bus crew suspects that the contents of the bags may cause delays during customs and border control procedures. The Passenger shall have the right to travel without such baggage. In case of refusal, it is considered that the Passenger voluntarily waived such a journey.
4.4.12 Transporting animals requires the approval of the carrier and a separate ticket. Animals are transported in their own designated seat with a separate ticket. The transportation of animals is limited to designated containers, cages, or other appropriate boxes. Dogs must wear a muzzle during transportation. All animals that are to be transported by the Carrier's bus shall be vaccinated, and the Passenger shall have necessary documentation to confirm this. The Carrier shall have the right to refuse the transportation of an animal if it behaves aggressively towards others, may cause harm to passengers or the bus, or may inconvenience other passengers during transportation. Damages caused by the animal to other passengers or the Carrier shall be compensated by the Passenger in full, taking into account fines, penalties, and any other expenses.
4.4.13 The Passengers with an excessive amount of baggage that cannot fit into the baggage compartment and refuse to travel, loses the right to a ticket refund. It is advisable to transport excess baggage ahead of time, especially during less crowded bus periods.
4.4.14 The Carrier assumes no responsibility for storing forgotten belongings and baggage left on the bus. Nonetheless, attempts will be made to locate the owner's forgotten belongings and transfer them to the nearest representative office of the carrier.
4.4.15 The bus staff may request passengers to show the contents of their baggage if doubts arise regarding journey safety and compliance with customs regulations. In the event that a passenger refuses to comply, the bus staff may refuse transportation of suspicious baggage.
5. COPYRIGHT, CONFIDENTIALITY AND USE DATA PERMISSION
5.1. All materials posted on the Website are intellectual property of LIKEBUS and its partners. All materials placed on the Website are protected by copyright and intellectual property rights, including, but not limited to, the design of the Website, names, trademarks, logos, texts, rights to databases, and other elements of the Website.
5.2. The Website User shall not have the right to partially or fully copy, distribute, or otherwise use or reproduce the Website content or underlying source code in any form without prior written permission from LIKEBUS.
5.3. All textual information and graphic images on the Website are the property of LIKEBUS and/or its contractors.
5.4. The User is not allowed to modify, reproduce, distribute, create derivative works, sell, or use LIKEBUS intellectual property in any other manner. Any of these actions will be considered a violation of copyright and will be subject to legal prosecution.
5.5. By making a purchase via the Website, the User confirms his/her legal capacity and gives consent for the processing of his/her personal data.
5.6. The User gives his/her consent and confirms that the information provided by him/her when purchasing the Ticket is truthful, and the User has the right to provide this information for the purchase of the Ticket and for further processing and storage, including, but not limited to:
- Transferring them to a third party that is in any way related to this Agreement, or for the purpose of its full implementation;
- Additional informing of the User about the status of the journey, changes in its conditions;
- Further processing of the User's orders;
- Receiving service messages, including those related to promotions, bonus programs, and discounts conducted by the Contractor.
5.7. The Contractor undertakes not to use the User's personal data for sending materials unrelated to the services provided by the Contractor, not to disclose personal data to third parties, and not to use them for any other purpose.
5.8. The User agrees to pay the ticket price and taxes applicable to all purchases made using credit or debit cards or any other authorized payment method.
5.9. The User agrees to compensate (pay) the Contractor for all funds specified by it in case the payment is not made, returned, or rejected by the Contractor's bank.
5.10. he Contractor, when selling a Ticket via the Website, confirms that it has the right to sell the said Ticket, in accordance with the terms and obligations determined by the Carrier.
5.11. The Contractor reserves the right at its discretion to block credit and debit cards for suspicious activity.
5.12. The User confirms their agreement to assume personal responsibility for any confidential information stored.
5.13. The Contractor is not responsible for any losses incurred due to unauthorized use of the confidential information left by the User.
5.14. All personal information obtained by the Contractor as a result of orders made via the Website is stored in accordance with applicable confidentiality laws.
5.15. The Contractor reserves the right to use and disclose information about the User or the orders made by the User, subject to confidentiality requirements.
6. RESPONSIBILITY OF THE PARTIES
6.1 In case of non-fulfillment or improper fulfillment of obligations by either Party under the Agreement, the guilty Party shall compensate the other Party for the losses caused and proven by such actions, the amount of which cannot exceed the ticket price.
6.2 The Contractor shall not be responsible to the User for the complete or partial non-functioning of the Website and its components at any time, as well as in case of the User's inability to access the system or for any direct or indirect expenses incurred by the User due to these circumstances.
6.3 The User understands and agrees that the Contractor is not responsible for any direct, indirect, incidental damages, and penalties, as well as inconveniences related to the transportation services (including, but not limited to, journey delays, cancellations, missed connections) or other possible issues that may arise in connection with the use of the Website.
6.4 The Contractor shall not be liable for losses and damages incurred by the User while traveling to different parts of the world.
6.5 The User agrees that he/she accesses the goods and services and information about bus transportation available on the Website at his/her own risk. The User's lack of acquaintance with the terms of the Agreement or the conditions of the Transportation Rules does not exempt him/her from responsibility for non-compliance with such terms and does not entitle him/her to demand compensation from the Contractor and/or the Carrier for the damage (losses) incurred due to such lack of knowledge.
6.6 The Contractor shall not be responsible for any losses and/or loss of the ticket for any mode of transport, for losses incurred by the User due to the bus being late to the point where the User was supposed to transfer, including those purchased under a single order via the Website.
6.7 The Contractor and/or Carrier hold no responsibility for occurrences outlined within this Agreement and the Rules of Transportation, especially but not limited to, cases where the Passenger is denied transportation as defined by this Agreement and the Rules of Transportation.
6.8 The User, in the event of purchasing a Ticket on behalf of a third party (Passenger), is obligated to compensate that person for all damages (losses) caused as a result of their lack of knowledge due to the User's fault regarding the terms of this Agreement and the Rules of Transportation.
6.9 The User, in the event of purchasing a Ticket on behalf of a third party (Passenger), is obligated to compensate that person for all damages (losses) caused as a result of their lack of knowledge due to the User's fault regarding the terms of this Agreement and the Rules of Transportation.
6.10 The User and/or the Passenger are obliged to compensate the Carrier for all damages, fines, and other expenses incurred by the Carrier due to the User's and/or Passenger's improper performance of the terms of this Agreement and the Rules of Transportation.
7. FORCE MAJEURE
7.1 The Carrier and the Contractor are released from liability for partial or complete non-fulfillment of obligations under this Public Offer if it resulted from force majeure circumstances (natural disasters, political or technogenic events, war or military actions, imposition of a state of emergency, actions of state authorities and their acts that directly prohibit, create conditions, or make it impossible for the Carrier to fulfill its obligations) that the Parties could not foresee, that are beyond their control, and if these circumstances directly affected the fulfillment of obligations under this Public Offer.
7.2 In the event of circumstances specified in clause 6.1, the Carrier and/or the Contractor shall notify the Passenger by any available means of communication. The notification should include information about the nature of the circumstances that prevent the fulfillment of the conditions of the Public Offer by the Carrier or the Contractor.
7.3 If force majeure circumstances persist for 3 (three) consecutive months and show no signs of cessation, this Agreement can be terminated by either Party by sending a notice to the other Party.
8. DISPUTE RESOLUTION PROCEDURE
8.1 If either Party breaches this Agreement, the other Party may seek recourse through the courts. The jurisdiction of the court will be determined in accordance with applicable laws of Ukraine.
8.2 All issues relating to the relations between the Parties not regulated by this Agreement shall be governed by legislation in force of Ukraine.
8.3 Disputes regarding the performance of this Agreement initiated by the User shall be resolved by the respective court at the location of the Contractor, following the claim procedure. The claim, in written form, shall be sent to the location of the Contractor. The Contractor will consider the claim within one month from the date of its receipt, unless otherwise specified by legislation in force of Ukraine.
9. ENTERING INTO, AMENDMENT AND TERMINATION OF THE AGREEMENT
9.1 This Agreement exclusively governs the conditions for purchasing the Ticket selected by the User, which, in turn, serves as evidence of entering into the transportation agreement, the terms whereof are regulated by the Conditions of Transportation available on the Website at the following link
likebus.ua/transportation-rules.
9.2 Agreement No. corresponds to Ticket No. purchased by the User. The date of entering into the Agreement is the date of making the payment for the selected Ticket.
9.3 This agreement shall be valid from the moment the User receives a text message confirming payment for the ticket purchase/receipt of the electronic ticket and shall be valid until the transportation service is provided.
9.4 All legal relations arising from or related to this Agreement, including those related to its validity, entering into, performance, modification, and termination, the interpretation of its terms, determining the consequences of its invalidity or violation, are governed by this Agreement and the relevant provisions of legislation in force of Ukraine, as well as the applicable business customs based on the principles of good faith, reasonableness, and fairness.
9.5 The current version of the Public Offer Agreement will take effect on the 28th of July, 2023.
9.6 The User shall have the right to modify or terminate the Agreement and make a refund for the Ticket on the terms and conditions specified in this Agreement.
9.7 In case of unilateral refusal by the User and/or Passenger to perform or continue transportation, it is considered that the User and/or Passenger unilaterally refused the transportation agreement, as a result of which the services under the offer agreement and under the transportation agreement are considered fulfilled, and the Parties have no claims against each other.
9.8 The Seller reserves the right to:
- Unilaterally terminate the provision of Services under this Agreement in case of the Passenger's violation of the terms of this Agreement.
- Adapt, modify, or terminate the Agreement at any time. In the event of changes, the terms of the new Agreement will be communicated to the User by publishing the new version on this Website. The new terms will apply only to sales made after the modifications have been made.
9.9 The Contractor shall have the right to terminate the Agreement at any time at its own discretion (for User’s violations of website usage rules - speculative bookings, unproductive searches, User’s actions that harm the website's functionality), by sending a notification to the User's e-mail provided during the Order placement.
